Premises and address for returns and complaints: BESTANGLER s.r.o., Na Pobřeží 67, 280 02 Kolín · e-mail [email protected] · tel. +420 725 723 721 (Mon–Fri 9 am–5 pm)
1. Basic Provisions
1.1. These terms and conditions govern the rights and obligations between BESTANGLER s.r.o. (hereinafter the "seller" or "we") and the buyer when purchasing in the e-shop. They form part of the purchase contract and the buyer will receive them as an attachment to the order confirmation. What we expressly agree with the buyer by e-mail takes precedence over these conditions.
1.2. A consumer is a person acting outside the scope of their business activity. Anyone who provides a Company ID (IČO) or VAT ID in the order is purchasing as a business; Articles 5 (withdrawal within 14 days) and 6 (consumer complaints) do not apply to businesses – Article 7 applies to them.
1.3. The contract is concluded in the language in which the buyer uses the e-shop and is governed by Czech law. A consumer residing in another state is not deprived of the protection afforded to them by the mandatory provisions of that state. We provide consumer rights under Articles 5 and 6 to all consumers regardless of the country of delivery. In the event of a discrepancy between the language versions of these conditions, the Czech version prevails. The seller is not bound by any code of conduct.
2. Order and Conclusion of Contract
2.1. Prices are displayed in the selected currency. For delivery within the European Union, prices are final and include VAT at the rate applicable in the country of delivery. For delivery outside the European Union, prices are shown exclusive of VAT; import VAT, customs duties and any carrier fees for customs clearance are paid by the buyer in their country upon import and are not part of the price – indicative information for individual countries is on the "Shipping" page. Current shipping and payment methods and their prices for the selected country of delivery are listed in the basket and on the "Shipping" page. If a discount is shown for goods, we also state the lowest price for the last 30 days before the discount. The presentation of goods in the e-shop is for informational purposes only; Section 1732(2) of the Civil Code (občanský zákoník) does not apply.
2.2. The buyer places an order by adding goods to the basket, selecting shipping and payment, and filling in their details; they can check and correct everything before submission. The order is submitted using the "Order with obligation to pay" button, thereby confirming that they have read these terms and conditions.
2.3. We will confirm receipt of the order by e-mail; the purchase contract is concluded upon delivery of the confirmation. If we cannot fulfil the order (goods are unavailable, obvious price error caused by a typo or system error), we will inform the buyer without undue delay, the contract is not concluded in this part, or we will withdraw from it, and refund any amount paid.
2.4. The buyer can also purchase via a user account; the details in it must be true and up to date, and access details must not be shared with third parties. We may cancel an account not used for more than 3 years.
3. Payment
3.1. Payment can be made in advance (by bank transfer or online by card or other payment method via a payment gateway), cash on delivery upon receipt from the carrier (if offered for the delivery country), or upon personal collection. Currently available payment methods and their cost are listed in the basket and on the "Shipping" page; the buyer receives payment details after completing the order and in its confirmation.
3.2. We only dispatch goods after the payment is credited. If advance payment is not credited within 5 days of concluding the contract, we withdraw from the contract and cancel the order. For cash on delivery and personal collection, the price is payable upon receipt. Discounts cannot be combined unless stated otherwise.
3.3. We are VAT payers registered under the One Stop Shop (OSS) scheme for sales to consumers in the EU. We send the tax document electronically to the buyer's e-mail; we accept payments in the currency of the order and refund them in the same currency and amount if necessary.
4. Delivery
4.1. Current delivery methods, carriers, prices and timeframes are listed in the basket and on the "Shipping" page; personal collection is possible at our premises in Kolín (Czech Republic). Delivery times abroad are indicative and do not include the time for customs clearance.
4.2. Goods in stock are usually dispatched within 1–2 working days of receiving payment (for cash on delivery, from contract conclusion); this is an indicative timeframe. Goods not in stock will be delivered within the timeframe stated for the goods or in the order confirmation, otherwise within 30 days. If we fail to deliver the goods even within a reasonable additional period, the buyer may withdraw from the contract.
4.3. The buyer is obliged to accept the goods. If repeated or alternative delivery is necessary for reasons on their part, they bear the associated costs. If the buyer fails to accept the parcel even within the carrier's alternative timeframe, we may withdraw from the contract; for a buyer who failed to accept a cash on delivery parcel, we may only allow advance payment for future orders.
4.4. The risk of damage to the goods passes to the consumer upon receipt. Upon receipt, we recommend checking the packaging; a damaged parcel can be refused or a report can be filed with the carrier and reported to us as soon as possible with photographs. Rights from defective performance remain unaffected.
4.5. Ownership of the goods passes to the buyer upon full payment of the purchase price and receipt of the goods.
5. Withdrawal from Contract within 14 Days (Consumer)
5.1. A consumer may withdraw from the contract without giving a reason within 14 days of receiving the goods (for multiple items, from receiving the last one). It is sufficient to send the withdrawal within this period – by e-mail to [email protected] or by delivery to the premises address; a model withdrawal form available for download on the "Returns and Exchanges" page can be used. We will confirm receipt by e-mail.
5.2. The consumer must send or hand over the goods to us within 14 days of withdrawal to the premises address in the Czech Republic (not cash on delivery). When sending from outside the EU, mark the parcel as "returned goods" stating the original order number; customs duties and fees incurred due to incorrect customs marking are borne by the consumer. The costs of returning the goods are borne by the consumer, even if the goods cannot be returned by normal postal means due to their dimensions (e.g. rods); their amount corresponds to the chosen carrier's price list for a parcel of given dimensions.
5.3. We refund the money only after we receive the goods back (or the consumer proves they have been sent, e.g. with a dispatch receipt), no later than 14 days from withdrawal, using the same method we received them, including delivery costs to the consumer corresponding to the cheapest delivery method we offer.
5.4. The goods must be returned in the condition in which they were delivered – unused, complete and in the original, intact packaging. The consumer may inspect the goods to the extent necessary to familiarise themselves with their nature and properties (as in a physical store); for goods in transparent, sealed or otherwise secured packaging (lures, hooks, rigs, lines, small accessories), the goods can be assessed without opening, and by opening the packaging they become unsellable as new. For a decrease in the value of the goods caused by handling beyond this scope (opened or damaged original packaging, use in fishing, traces of use, missing parts), we may claim compensation up to the purchase price and set it off against the refunded amount.
5.5. Withdrawal is not possible for goods customised to the buyer's wishes (e.g. custom rod modifications) and in other cases under Section 1837 of the Civil Code. If a gift was provided with the goods, it must be returned along with the goods.
5.6. Beyond the law, we allow the exchange of unused goods in their original packaging for another variant within 30 days of receipt under the conditions on the "Returns and Exchanges" page.
5.7. The seller may withdraw from the contract before handing over the goods if the goods are unavailable, there was an obvious pricing error, or the buyer failed to pay within the deadline (Article 3.2); we will refund the paid amount within 14 days.
6. Rights from Defective Performance and Complaints (Consumer)
6.1. We guarantee that the goods are free from defects upon receipt – they match the description, have the usual properties and are suitable for their usual purpose. We are not liable for wear and tear caused by normal use, damage from improper use or maintenance, and defects we pointed out and for which a lower price was agreed.
6.2. The consumer can claim a defect that becomes apparent within 2 years of receipt.
6.3. The consumer may demand repair or delivery of a new item (at their choice, unless the chosen method is impossible or disproportionately expensive). If we do not remedy the defect within a reasonable time or refuse to remedy it, the defect appears repeatedly, or it constitutes a material breach of contract, the consumer may demand a reasonable discount or withdraw from the contract. Withdrawal is not possible for minor defects.
6.4. The consumer applies the complaint by e-mail to [email protected] or in writing/in person at the premises address; the complaint is made at the moment the defect is reported. They will send or hand over the goods to us (not cash on delivery); for customers from abroad, we may agree to assess the defect from photos or video without returning the goods. We will confirm receipt of the complaint by e-mail and settle it no later than 30 days from the claim, unless we agree on a longer period; otherwise, the consumer may withdraw or request a discount. We will issue a confirmation of settlement; we will justify a rejection in writing.
6.5. In the case of a justified complaint, we will reimburse the consumer for purposefully incurred costs (especially postage) if they request them within 1 month after the expiry of the period for claiming the defect.
6.6. Rights from defective performance are further governed by Sections 1914–1925, Sections 2099–2117 and Sections 2161–2174b of the Civil Code.
7. Buyer-Business
A business shall point out obvious defects without undue delay after receipt, hidden ones no later than 12 months; rights from defects are governed by Sections 2099–2117 of the Civil Code, we do not provide a quality guarantee. The risk of damage passes upon handing the goods to the carrier. Returning unused goods is only possible by agreement. Liability for damage is limited to the purchase price.
8. Personal Data and Commercial Communications
8.1. The data controller is BESTANGLER s.r.o. We process the name, address, e-mail, phone number, Company ID/VAT ID for businesses, order and payment data (never payment card data) and e-shop usage data for processing the order (performance of contract), bookkeeping (legal obligation), user account management, handling complaints and protecting our rights and sending commercial communications to our customers about our goods (legitimate interest). We retain order data for the period during which rights from the purchase contract can be exercised and for which accounting and tax regulations require us to retain them; user account data for its duration; we send commercial communications until the buyer opts out.
8.2. We transfer data only to carriers (for delivery), payment service providers (payment gateways, e.g. ComGate, Stripe, PayPal – for processing payment), shop review services (Trustpilot, Google, formerly Heureka – request to review purchase, can be refused) and, based on cookie consent, operators of analytics and advertising tools (Google, Meta, Seznam); also to authorities where required by law. We do not sell data.
8.3. The buyer has the right to access, rectify, erase, restrict processing, data portability, the right to object (opt-out of commercial communications at any time via a link in the e-mail, checking a box in the order or by e-mailing [email protected]) and the right to lodge a complaint with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů, www.uoou.gov.cz). We process requests at [email protected] within 1 month.
8.4. Cookies strictly necessary for the operation of the e-shop are used without consent; analytical, marketing and preference cookies only with consent granted in the cookie banner, which can be changed at any time via "Cookie settings" in the footer. Details are on the "Cookies" page.
9. Dispute Resolution and Supervision
9.1. We handle complaints at [email protected]; we inform the buyer of the outcome by e-mail. Consumer disputes arising from a purchase contract can be resolved out of court through the Czech Trade Inspection Authority (Česká obchodní inspekce), Gorazdova 1969/24, 120 00 Prague 2, adr.coi.cz, within 1 year from the first exercise of the right with the seller. Consumers from other EU countries can also use the European Consumer Centre Czech Republic (www.evropskyspotrebitel.cz) or the out-of-court dispute resolution body in their country.
9.2. Supervision over consumer protection is exercised by the Czech Trade Inspection Authority (www.coi.gov.cz), over personal data protection by the Office for Personal Data Protection, and trade licensing control by the relevant Trade Licensing Office (živnostenský úřad).
9.3. We obtain store reviews via a request sent to customers by e-mail after order delivery (currently Trustpilot and Google, formerly Heureka "Verified by Customers"); for Google reviews, we verify the origin manually against our orders and reviews where we successfully traced the customer are marked "Verified Customer"; others are displayed without this mark. We do not edit reviews and do not delete negative ones.
10. Final Provisions
10.1. Correspondence takes place by e-mail (to the buyer at the address from the order, to us at [email protected]); withdrawal and complaints can also be sent by post to the premises address.
10.2. The buyer assumes the risk of a change in circumstances (Section 1765(2) of the Civil Code). If any provision is invalid, the others remain valid.
10.3. We may change the wording of the terms and conditions; the order is governed by the wording effective on the day of its submission, which the buyer receives by e-mail.
10.4. These terms and conditions come into effect on 25 September 2026.
